End User License Agreement (EULA)

This End User License Agreement ("Agreement") is between you and Bear Den Labs Pty Ltd (ABN 64 686 731 046) ("Bear Den Labs," "we," or "us"). By downloading, installing, or using Affirmation Lock ("App"), you agree to the terms and conditions set forth in this Agreement.

1. Acknowledgment

You acknowledge that this Agreement is between you and Bear Den Labs only, not with Apple, and Bear Den Labs, not Apple, is solely responsible for the App and its content.

2. Scope of License

Bear Den Labs grants you a limited, non-exclusive, non-transferable, revocable license to use the App solely on Apple-branded products owned or controlled by you, strictly in accordance with this Agreement and Apple's App Store terms and Usage Rules.

3. Maintenance and Support

Bear Den Labs is solely responsible for providing any maintenance and support services concerning the App, as specified in this Agreement or required under applicable law. Apple has no obligation to furnish any maintenance or support services for the App.

4. Wellness Disclaimer

Affirmation Lock is a wellness and focus tool, not a medical or mental health service. The App is not intended to diagnose, treat, cure, or prevent any condition. If you are experiencing a mental health crisis, please contact a qualified professional or emergency services.

5. Screen Time and App Blocking

The App uses Apple's Screen Time APIs to help you pause before opening selected apps. You are solely responsible for configuring which apps are blocked and for any consequences of those choices. Bear Den Labs is not liable for missed notifications, blocked access to essential services, or any disruption caused by your Screen Time configuration.

6. No Liability for Content

Bear Den Labs provides the App and its content for general wellness and focus purposes. We do not guarantee the accuracy, appropriateness, or completeness of affirmations or other content. Bear Den Labs will not be held liable for any direct, indirect, incidental, or consequential damages arising from use or inability to use the App.

7. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by applicable law, Apple has no other warranty obligations concerning the App.

8. Product Claims

Bear Den Labs, not Apple, is responsible for addressing any claims related to the App, including product liability claims and claims arising under consumer protection or similar legislation.

9. Intellectual Property Rights

All rights, titles, and interests in and to the App are exclusively owned by Bear Den Labs or its licensors. You may not reproduce, modify, distribute, or create derivative works from the App or its content without explicit written permission from Bear Den Labs.

10. Subscriptions

Some features require a paid subscription processed through Apple's App Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your App Store account settings.

11. Legal Compliance

You represent and warrant that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government list of prohibited or restricted parties.

12. Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance, Apple will have the right to enforce this Agreement against you as a third-party beneficiary.

13. Termination

Bear Den Labs may terminate your access to the App at any time, without notice, if you breach this Agreement. Upon termination, you must cease using the App immediately.

14. Governing Law

This Agreement is governed by the laws of Australia. Any disputes shall be subject to the jurisdiction of the courts located within Queensland, Australia.
